Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Cooling-off Period: The period within which the consumer may exercise the right of withdrawal.

  • Consumer: A natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur.

  • Ongoing Contract: A distance contract concerning a series of products or services with obligations spread over time.

  • Right of Withdrawal: The consumer’s right to withdraw from the distance contract within the cooling-off period.

  • Entrepreneur: R&C ECOM, the natural or legal person offering products remotely to consumers.

  • Distance Contract: An agreement concluded between the entrepreneur and the consumer using remote communication techniques.

  • CESOP: The Central Electronic System of Payment Information introduced by the EU to monitor payment service providers.

Article 3 – Applicability

These Terms and Conditions apply to every offer by the entrepreneur and to every distance contract concluded with the consumer. Before the agreement is finalized, these Terms and Conditions will be made available electronically or otherwise.

Article 4 – The Offer

  • All offers are non-binding. The entrepreneur reserves the right to modify offers at any time.

  • Each offer clearly states the total costs, including shipping fees, customs duties, and any additional charges collected by the courier or postal service.

Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and complies with the specified conditions. Acceptance will be confirmed immediately by email.

Article 6 – Right of Withdrawal

  • Consumers may withdraw from the contract within 14 days of receiving the product without stating a reason.

  • Return shipping costs are at the expense of the consumer when exercising this right.

Article 7 – Costs in Case of Withdrawal

The entrepreneur will reimburse all payments within 14 days after the withdrawal, provided the product is returned in its original condition and packaging.

Article 8 – Customs, Import Duties, and VAT Liability

  1. All goods are shipped under the Delivered Duty Unpaid (DDU) term (Incoterms 2000). The consumer is fully responsible for all costs and obligations related to importation.

  2. These obligations include, but are not limited to:

    • payment of import duties, VAT/GST, and other applicable taxes;

    • customs clearance costs such as brokerage, inspection, or handling fees;

    • compliance with local laws, product regulations, and certification requirements.

  3. The entrepreneur does not act as the importer of record. Legal title and responsibility transfer to the customer upon shipment.

  4. The entrepreneur supplies the necessary commercial documents (invoice, product description, declared value), but cannot guarantee that goods or documents meet all local requirements.

  5. The customer indemnifies the entrepreneur from any claims, fines, or liabilities resulting from non-compliance with import regulations.

  6. Customers are strongly advised to check local customs requirements before placing an order to avoid unexpected charges or delays.

Article 9 – CESOP Compliance

From 2024, payment service providers are required to register transaction data in the CESOP system (Central Electronic System of Payment Information). R&C ECOM complies with these EU regulations, which may affect the monitoring and reporting of payments.

Article 10 – Conformity and Warranty

  • The entrepreneur ensures that products comply with the agreement and legal standards.

  • Complaints regarding defects must be submitted in writing within 14 days of delivery.

  • Products must be returned in their original packaging and condition.

Article 11 – Delivery

  • Orders are delivered within 30 days, unless otherwise agreed.

  • In case of delays, the consumer will be informed within 14 days after placing the order.

  • All orders are shipped under DDU terms, making the consumer responsible for any import-related processes.

  • The entrepreneur ensures proper dispatch of products but is not liable for customs delays.

  • Failure of the consumer to comply with import obligations does not entitle cancellation or refund.

Article 12 – Complaints

  • Complaints must be submitted in writing within 7 days after discovery of the issue.

  • The entrepreneur will respond within 14 days. If a longer period is required, the consumer will be notified with an expected resolution time.

Article 13 – Disputes

These Terms and Conditions are governed by Dutch law. Disputes will preferably be resolved amicably. If not possible, disputes will be submitted to the competent court in the Netherlands
